Chicago Medical Malpractice Lawyers

When you go to the emergency room or a scheduled appointment with your doctor, you expect to receive a certain standard of care. You expect to receive an accurate diagnosis, and you expect to receive treatment that is designed to give you the best chance of making a full and speedy recovery.

While we trust doctors and medical facilities with our health – and, in many cases, our lives – experience has shown that this trust is too often misplaced. In 2016, Johns Hopkins University released the results of a shocking study which revealed that medical mistakes were the third-leading cause of death in the United States. Even with this alarming statistic, we know that far more instances of medical malpractice go unreported, and that non-fatal medical mistakes are, unfortunately, a routine occurrence.

MESOTHELIOMA PROGNOSIS

The prognosis and average life expectancy with stage 1 mesothelioma is higher than with stages 2, 3 or 4. Unfortunately this diagnosis is atypical as stage 1 mesothelioma would not typically present any symptoms. Without symptoms a diagnosis of stage 1 mesothelioma typically only occurs when the cancer is found while seeking or treating unrelated health conditions.

At stage 1, the cancer can only be located within a single area (possibly as one or several separate tumors in a single area), hasn’t invaded critical organs, hasn’t been discovered within the lymphatic system and is a great candidate for surgery to remove the primary tumor.

MESOTHELIOMA

Mesothelioma is a rare type of cancer that is often caused by exposure to asbestos, usually as part of the victim's job. Asbestos is a silicate mineral that was used in a number of household, automotive, and industrial items until the 1980s, when the dangers of the mineral were discovered. Those with mesothelioma usually develop cancer in the lining around the abdominal cavity as well as in the lungs and heart. Treatment for any type of cancer can be a lengthy and expensive process, and mesothelioma is especially difficult.

The Asbestos Legal Center attorneys have over 20 years of combined experience aggressively, yet compassionately representing individuals and families affected by asbestos. Our California asbestos lawyers invite you to use this website as a resource for all asbestos related questions. Whether you have served in the military or have a loved one that has been diagnosed with an asbestos related disease it is our goal to provide you with the resources and knowledge required to make an informed decision about your medical future.

WHAT IS ASBESTOS?

Asbestos is a mineral that consists of very fine, microscopic, needle-shaped fibers. The fibers are so small that you cannot see them unless the concentration in the air is very heavy. Asbestos is strong, resists heat, acids, friction, and is virtually indestructible; therefore, it is an excellent material for many uses. Asbestos becomes a health hazard only when these materials crumble, fall apart, are damaged or ripped. When asbestos materials are damaged the fibers become air born where they may stay suspended for a long period of time. The fibers can then be inhaled and become lodged deeply in the lungs.

Mesothelioma & Asbestos

Mesothelioma is a rare form of cancer that affects cells found in the mesothelium, a protective membrane surrounding the majority of the body’s internal organs. The cells that make up this membrane protect the organs by making a special fluid that allows the organs to move and, in particular, help the lungs to move during breathing.

The vast majority of people who develop this deadly disease have inhaled asbestos particles, often through their jobs. In fact, a history of asbestos exposure in the workplace is reported in approximately 70 to 80 percent of all mesothelioma cases. In addition to mesothelioma, the inhalation of the deadly mineral fibers can cause lung cancer and asbestosis. The World Health Organization estimates that asbestos-related diseases kill approximately 107,000 people around the world each year.

Asbestos was originally prized by the ancient Greeks and Romans due to its resistance to fire and use as an insulator. Use of the mineral increased rapidly during the 19th century, particularly during the Industrial Revolution. By the mid-1930s, however, it was known that exposure to asbestos could cause a range of serious illnesses.

Our California mesothelioma law firm is limited to cases involving catastrophic injury and death from exposure to asbestos.

Since its founding in 1974, Kazan Law has represented thousands of people suffering from asbestos related illnesses, particularly mesothelioma. Among our principals are pioneers in asbestos litigation — the most experienced mesothelioma lawyers in California. We have unparalleled expertise in asbestos bankruptcy reorganizations and asbestos bankruptcy funds.

Kazan Law employs a staff of more than 80, including 25 attorneys and a team of paralegals and professional investigators. We specialize in complex litigation involving catastrophic professional liability and personal injury.

Mesothelioma / Asbestos

If you or a loved one has been diagnosed with mesothelioma, Harowitz & Tigerman can help. Our trial lawyers have decades of experience fighting for people afflicted with this deadly disease.

Maybe you are a daughter who wants to know why her father was hurt when he worked in California and who is responsible; maybe you suffered from asbestos exposure in California, or perhaps you are a Bay Area neighbor of ours whose family member worked with asbestos and brought asbestos fibers home on their clothes. In any case, there are some important facts that you should know.

Malignant mesothelioma is an uncommon tumor, but it is clear that virtually all cases arise in people who were exposed to asbestos fibers. Mesothelioma and asbestosis are life-threatening diseases: although new treatment protocols provide hope, the median duration of survival, according to the literature, is 14 to 18 months.

Despite the limited survival rate for mesothelioma victims, in most states it can take 3-5 years for a mesothelioma claim case to reach the trial stage. However, because of our extensive experience in complex asbestos litigation, the lawyers of our firm know how to take advantage of California’s special procedures, which can get a mesothelioma lawsuit to trial in just a few months.

Mesothelioma Lawsuit

Why People File Mesothelioma Lawsuits

Mesothelioma is a life-altering diagnosis. Victims of this asbestos cancer are forced to endure life- changing pain and suffering. Most suffer intense physical pain and loss of the most taken-for-granted of life’s pleasures, including the ability to breathe. Most suffer enormous mental and emotional anguish as they deal with mesothelioma’s effects on them and their family members.

Many mesothelioma victims endure often debilitating treatments such as chemotherapy and extensive surgeries.

At the time of their exposure to asbestos, decades before mesothelioma appears and is diagnosed, victims did not know they were at risk from their work with and around asbestos-containing products and equipment. The companies that manufactured and sold these products, however, knew, some as early as the 1930s.

Mesothelioma lawsuits are one way for mesothelioma cancer patients and their families to obtain compensation for the pain and suffering associated with this deadly disease. These lawsuits are also a way to gain financial security and to hold the asbestos industry accountable for the devastating harm it caused.

What Causes Mesothelioma?

The primary risk for developing mesothelioma is through exposure to asbestos.

Asbestos is a naturally occurring mineral that is known for its strength, durability and capacity to resist fire and heat. It is located in the mines of various regions in the world. Asbestos was widely used in a variety of commercial and industrial applications and products for much of the 20th century because it was inexpensive to obtain and excellent for heat and fireproofing. As the link between asbestos and mesothelioma became more apparent, the use of this material has decreased. However, unfortunately up to 8 million Americans may already have been exposed to asbestos.

How Asbestos Causes Mesothelioma

When asbestos fibers are inhaled, they become embedded in mucus membranes inside the air passages, similar to how a small sliver becomes embedded in the skin. The long, thin, fibers are sharp, and cannot be cleared when they penetrate into the pleural lining of the lung and chest wall. These fibers will eventually cause mesothelioma.

Asbestos fibers can also damage cells of the lung causing asbestosis or lung cancer. The risk of lung cancer among people exposed to asbestos is increased by 7 times, compared with the general population. Indeed, asbestosis, mesothelioma, and lung cancer are the three most frequent causes of death and disease among people with heavy asbestos exposure. Peritoneal mesothelioma, which forms in the abdomen, may result from coughing up and swallowing inhaled asbestos fibers. Cancers of the larynx, pancreas, esophagus, colon, and kidney have also been linked to asbestos exposure, but the increased risk is not as great as with lung cancer.

The risk of developing mesothelioma directly relates to both how often the person is exposed to asbestos and how long these exposures last. People exposed at an early age, for a long period of time, and at higher levels of fiber density are most likely to develop cancer.

Although the risk of developing mesothelioma increases with the amount of asbestos exposure, it is clear that genetic factors also play a role in determining who develops the disease. This explains why not all persons exposed to high levels of asbestos particles develop mesothelioma.

Asbestos and Mesothelioma

Asbestos is a mineral fiber historically used among manufacturers and builders because of its resistance to heat, electricity, and chemical damage, as well as its sound absorption properties and durability. When inhaled, microscopic asbestos fibers can bypass the body's natural defenses and work their way deep into the lungs. There, the fibers accumulate and irritate the lung tissue, which often leads to the development of asbestos-related diseases, including mesothelioma and asbestosis.

At the Locks Law Firm, Pennsylvania, New Jersey, and New York mesothelioma and personal injury attorneys can help you and your family obtain compensation for medical bills, lost wages, and pain and suffering if you or a family member has this terrible disease. Asbestos & Ovarian Cancer

Studies have now found considerable links between asbestos exposure and ovarian cancer, and suggest women who have been exposed to asbestos are 1.77 times more likely than those not exposed to develop the deadly disease. These women were exposed by frequent use of asbestos-contaminated talcum powder products. These products, commonly used for feminine hygiene, have been contaminated with asbestos for decades. Manufacturers of these products failed to adequately warn users about the dangers and continued to market the products as safe.

I WAS RECENTLY DIAGNOSED WITH MESOTHELIOMA. I THINK I DESERVE COMPENSATION, BUT I HAVE TO START MY MEDICAL TREATMENT. IS IT OK TO DELAY A LAWSUIT?

It is important to start your mesothelioma lawsuit as soon as possible, even while you are undergoing medical treatment.

First, the law also provides a limited amount of time for filing a lawsuit. This is called the statute of limitations. In most states the time limit to file a lawsuit for mesothelioma is no more than two years from the date of diagnosis and in some states it is only one year.

Second, the sooner you act, the sooner you might receive compensation that could help with your medical bills and financial needs. Some judges will speed up the process for mesothelioma plaintiffs because they know that mesothelioma is a life-threatening illness, requiring significant resources for medical treatment.

Third, under the laws of some states, if someone with mesothelioma dies before the case is concluded, the case could face significant delays.

Fourth, you are the best witness in your case, and it is important to preserve your testimony about your asbestos exposure history.

What is Mesothelioma? - An Introduction to Mesothelioma

Mesothelioma is a devastating form of cancer usually linked to the inhalation of asbestos fibers. Asbestos particles are tiny, sharp fibers that are extremely harmful when swallowed or inhaled. These fibers remain in the lungs and abdomen, and work their way to the outer wall of the chest and into the mesothelium membrane. This membrane protects and fixes the organs of the body while allowing for flexibility and providing necessary lubrication. Asbestos can scar the mesothelium, causing tumors that generate pain throughout the body. Although these fibers can be found in low levels everywhere, they become a danger when they are present in abundance. In the 1900s, asbestos was used in many products, including fire retardants, insulation, pipes, cement, roof coatings and other items, many of which can be found in older homes. Ceiling coatings, such as the infamous "popcorn" ceiling, should be considered to contain asbestos. The federal government has banned some asbestos products, but many are still allowed under current law, meaning mesothelioma is an ongoing danger.

Mesothelioma

Effects of asbestos can take decades to appear

Mesothelioma or asbestos litigation is a type of toxic tort lawsuit. These lawsuits are typically brought against manufacturers, distributors, and suppliers of asbestos, a known carcinogen used at one time in many products. Mesothelioma cases usually involve people facing terminal illness and great hardship. Even so, these cases can be difficult to prove. Often, a long period of time elapses between exposure to asbestos and the diagnosis of mesothelioma or asbestos-related disease. Typically, several decades may pass before the symptoms of mesothelioma appear. Other asbestos-related diseases include lung cancer and asbestosis.

Waters Kraus & Paul holds asbestos manufacturers, distributors, and others accountable for their part in causing mesothelioma. Our asbestos lawyers have successfully prosecuted cases for clients who were exposed throughout the United States, Canada, and even the Middle East including Iran, where many American citizens worked in refineries.

Mesothelioma

Mesothelioma is a rare form of asbestos-related cancer that develops in the mesothelial cells. These cells form tissue that surround or line the lungs, heart and stomach. Mesothelioma is considered a rare cancer, with only 2,000-4,000 individuals a year diagnosed in the United States

Causes of Mesothelioma

Asbestos exposure is the overwhelming cause of Mesothelioma in the United States. Typically, asbestos exposure usually occurred in an occupation or work environment. It is also well established, however, that working near others using asbestos products and household exposures (exposure from family members and their work clothes in the home) are known causes of Mesothelioma.

The majority of mesothelioma diagnoses could have been prevented because, as early as the 1930s, companies selling asbestos and asbestos products knew that asbestos was extremely dangerous and potentially deadly. Regrettably, many companies did nothing about it, and the effects of those decisions are killing people today.

Our Firm is comprised of experienced trial attorneys who possess knowledge and familiarity with asbestos-related diseases. We believe that those injured by careless asbestos exposure have the right to fair recompense for their suffering, and we are committed to holding the reckless companies responsible.

MESOTHELIOMA CANCER INFORMATION

If you’re on the fence or considering whether to hire a mesothelioma lawyer, here’s a little bit more information about mesothelioma to help you understand the unique circumstances and risk factors of asbestos exposure for this type of cancer. Mesothelioma is a very serious but rare form of malignant cancer that is almost always caused by asbestos exposures. The most common forms of mesothelioma are:

Peritoneal Mesothelioma

Pleural mesothelioma is a type of cancer that affects the lining of the lungs (called the pleura). Peritoneal mesothelioma is a type of abdominal asbestos cancer that starts in the lining of the abdominal cavity (called the peritoneum).

Other types include pericardial mesothelioma (affecting the heart), and the rarest form — testicular mesothelioma.

More Mesothelioma Facts

Did you know that even brief or minimal exposure to asbestos can cause mesothelioma?
Unfortunately, it’s true. For example, in several cases, we have represented mesothelioma victims who are wives and children of workers who unknowingly brought asbestos dust into their homes on their work clothes (called second-hand asbestos exposure).

Mesothelioma is a “dose-response” disease.

This means that the more a person is exposed to asbestos, the greater the risk he has for developing the disease.

Mesothelioma has a long latency period.

This means that victims of mesothelioma were exposed to asbestos many years before the cancer developed. The average latency period for mesothelioma is approximately 30 years but can be shorter than 15 years or longer than 40 years.

Related Asbestos Diseases

Victims of mesothelioma may also have another asbestos-related disease such as asbestosis or pleural disease. These non-cancerous conditions, although caused by asbestos, are medically separate and distinct diseases from mesothelioma. Therefore, a disease such as asbestosis does not “develop” into mesothelioma.

Because asbestosis has a shorter latency period than mesothelioma, some mesothelioma victims also develop asbestosis many years before developing the cancer. Medical experts believe that less than 15% of asbestosis victims will ever develop mesothelioma. Also, a person can develop mesothelioma but never have asbestosis or any other asbestos-related disease.

Although asbestosis is also a terrible asbestosis disease, unfortunately, our attorneys can only file a compensation claim if you have been diagnosed with mesothelioma.

EXPERIENCE MATTERS IN ASBESTOS LAWSUITS

Baron & Budd’s asbestos litigation lawyers were among the first in the country to take on an asbestos-related case, more than 40 years ago, and our dedication to helping mesothelioma victims has only increased over the years. Today Baron & Budd’s team of dedicated mesothelioma lawyers works across the nation, winning many precedent-setting cases and handling many mesothelioma claims. If you have been diagnosed with mesothelioma, you are likely entitled to compensation from those responsible. Make sure you have the best mesothelioma attorneys on your side throughout the legal process.

Mesothelioma litigation has attracted many lawyers who have never set foot in a courtroom. Unlike Baron & Budd, these types of “marketing” lawyers merely advertise for cases and then send them to the highest bidder for handling. When you hire Baron & Budd, you will have a mesothelioma lawyer from our firm handling your case who has decades of experience and substantial resources to help your case.

How is Baron & Budd Different from Other Mesothelioma Law Firms?

The cornerstone of our practice has long been mesothelioma. Our mesothelioma lawyers are still fighting for the rights of victims and their families more than 40 years later.
